Notice pursuant to Articles 13 and 14 of Regulation (EU) 679/2016 – General Data Protection Regulation (“GDPR”).
Pursuant to and for the purposes of the above-mentioned regulation, our Real Estate Agency hereby wishes to inform you in advance both about the use of your personal data and about your rights, as follows:
1. DATA CONTROLLER
The Data Controller is Ortalloggi di Alice Pellegrino, with registered office in Orta San Giulio in Via Giovanetti n. 3.
2. PERSONAL DATA SUBJECT TO PROCESSING
For the purpose of carrying out real estate consultancy and brokerage activities, and in order to satisfy your request for services, we use certain data relating to the data subject. These include identification data, contact details (address, landline telephone, mobile phone, fax, e-mail), data relating to the property, data relating to your financial capacity, land registry certificates and documents of property origin, and data relating to the composition of your household.
3. PURPOSE, LEGAL BASIS AND MANDATORY OR OPTIONAL NATURE OF THE PROCESSING
Such data will be provided by the data subject and collected by our staff and collaborators, also through electronic or telematic means, in order to carry out real estate consultancy and brokerage activities, to perform a service or an operation contractually agreed upon, and to verify the performance of contractual relationships as well as the risks related to them. It should be noted that the provision of such data is mandatory in the sense that otherwise we would not be able to fully or partially fulfil the above-mentioned mandate, and that your data may also be collected from other subjects. Some information may also need to be communicated by you or by third parties due to legal obligations (for example pursuant to anti-money laundering regulations).
Your identification data will also be processed in order to fulfil obligations provided for by state laws, regulations and European legislation, or by provisions issued by authorities legally entitled to do so and by supervisory or control bodies. Such processing does not require the consent of the data subject.
Information relating to your property, including images of it, will also be processed for promotional and commercial activities aimed at the proper execution of the mandate entrusted to us, and may therefore be disclosed through publication on websites, social networks and/or printed publications of the data controller, subject to your explicit consent.
Your e-mail contact details may be used by the data controller to send you commercial communications regarding products and services similar to those provided, pursuant to and for the purposes of Article 130 paragraph 4 of Legislative Decree 196/2003 as amended by Legislative Decree 101/2018. You may object to this processing purpose at any time. Such objection will have no effect on the main purpose of carrying out real estate consultancy and brokerage activities.
4. RECIPIENTS
Your data will be made accessible to our internal administrative staff and to our external collaborators, whose list is available at our office, and will also be communicated to our service providers such as IT service companies, outsourcing companies, consultants and self-employed professionals, insurance companies, debt collection companies, fraud control companies, institutions and/or patronage bodies, companies or entities appointed by us as data processors for the specific processing, whose list is available at our office.
Furthermore, your data may be communicated to technicians for all the checks on the property of your interest to be carried out at the Technical Office, the Land Registry and/or other Institutions, Bodies or Registers.
5. TRANSFERS
Some of your Personal Data may be transferred to Recipients that may be located outside the European Economic Area. The Data Controller ensures that the electronic and paper processing of your Personal Data by the Recipients takes place in compliance with the Applicable Legislation. In fact, transfers are alternatively based on an adequacy decision or on the Standard Model Clauses approved by the European Commission. 6. DATA RETENTION
All personal data provided will be processed in compliance with the principles of lawfulness, fairness, relevance and proportionality, only with the methods, including electronic and telematic ones, strictly necessary to pursue the purposes described above. In any case, personal data will be stored for a period not exceeding the time strictly necessary to achieve the indicated purposes. Personal data that no longer need to be stored in relation to the indicated purposes will be deleted or transformed into anonymous form. It should be noted that the information systems used for managing the collected information are configured, from the outset, in such a way as to minimize the use of data.
7. YOUR RIGHTS
Finally, please note that as a data subject you have the rights set out in Article 15 GDPR and specifically the rights to:
I. obtain confirmation as to whether or not personal data concerning you exist, even if not yet recorded, and their communication in intelligible form;
II. obtain information regarding:
a) the origin of the personal data;
b) the purposes and methods of the processing;
c) the logic applied in the case of processing carried out with the aid of electronic instruments;
d) the identification details of the controller, the processors and the representative designated pursuant to Article 3, paragraph 1, GDPR;
Where applicable, you also have the rights set out in Articles 16-21 GDPR (Right to rectification, right to be forgotten, right to restriction of processing, right to data portability, right to object), as well as the right to lodge a complaint with the Supervisory Authority.
